konduktum - Terms of Service
Effective: 2026 — Konduktum OÜ, Narva mnt 5, Tallinn, Estonia
These terms are written to be understood, not to hide things. Legalese appears in Section 2 onwards as required by law, but the plain-English summary above each section is binding in spirit. If anything conflicts between the summary and the legal text, tell us immediately at support@konduktum.com.
1. Who We Are and What We Believe
Our fundamental belief: creators own their work, their audience, and their creative future. We exist to serve that belief, not to profit from undermining it.
Konduktum OÜ is a platform company registered in Estonia and currently operated and maintained by us: @kemane and @CanRau. We build infrastructure from scratch without any investors, with our own money and resources. We build @konduktum for creators — musicians, artists, filmmakers, writers, and anyone making work that matters.
We make money when you make money — a transparent fee on funded demands only. We do not sell advertising. We do not monetise your content. We do not use your work to promote ourselves without your explicit, specific consent each time.
2. How the Platform Works
2.1 Demand-Based Crowdfunding
Konduktum operates a demand-first crowdfunding model. Fans (Pledgers) initiate Demands for creative work. Creators review Demands and choose — freely and without obligation — whether to accept or reject them.
2.2 For Creators
Accepting a Demand
When a Pledger opens a Demand for your work, no money is collected. Pledgers are only charged when you click the green “Accept” button. You decide the timeline. You control the output.
Rejecting a Demand
You can reject any Demand, at any time, for any reason, including no reason. Rejection is a legitimate and respected act on this platform. It is how you define your creative boundaries and communicate honestly with your audience.
There is no obligation, no pressure, and no penalty for rejecting. Konduktum is not a job market. You are a creator, not a contractor.
2.3 For Pledgers
You may initiate a Demand for any creator on the platform. You set your own pledge amount. You are only charged if and when the creator accepts the Demand. If the creator rejects the Demand or does not respond, no charge is made, and no funds are collected.
3. Creator Content: You Own It. Fully. Always.
This is the most important section of these Terms. Read it carefully.
3.1 Full Ownership
All content you create and deliver through Konduktum is yours. 100%. Konduktum claims no ownership, co-ownership, or creative interest in your work — before, during, or after delivery.
This includes: music, recordings, videos, visual art, writing, source files, live sessions, and any other form of creative output you produce, upload, or deliver via the platform.
3.2 The Platform Licence (What We Need to Operate)
To host and deliver your content to your audience, we require a limited technical licence. This is narrowly scoped and exists solely to run the platform:
- Host your content on our servers
- Deliver your content directly to your subscribers’ inboxes
- Store backups of your content for technical redundancy and your own data protection
That is the entire scope of our licence. Nothing more.
We will never: reproduce your content for advertising; sublicence your work to third parties; reformat your work beyond technical compatibility requirements; use your name, likeness, or creative work to promote Konduktum without your specific written consent on each occasion.
3.3 Moral Rights
We respect your moral rights. We do not ask you to waive them. You retain the right to be credited as the creator of your work, and the right to object to treatment of your work that damages your reputation or distorts your intent.
3.4 No Advertising With Your Work
Konduktum does not run advertising. We do not show ads on the platform. We will not use your content, your name, your voice, your image, or your creative output in any promotional or advertising capacity without your prior, specific, written consent for that particular use.
If we ever wish to feature your work — for example in a case study, a press release, or a social post — we will ask you directly. You can say no. We will not take it personally.
3A. Artificial Intelligence & Generative Content
3A.1 Why This Section Exists
Generative AI is changing what it means to make images, music, and other creative work. We don’t have a position on whether AI-generated work is or isn’t “real” art. That debate belongs to culture, not to us.
What we do have a position on is honesty. Your audience funds your work through Konduktum. They deserve to know what they’re funding. This section establishes what you must disclose, how to disclose it, and what we will not do with that information.
This section also reflects our obligations under the EU AI Act (Regulation (EU) 2024/1689), which requires that AI-generated content presented to the public be transparently labelled. As an Estonian entity, Konduktum is subject to this regulation. Compliance here is not optional — but we’ve written it in a way that goes further than the minimum the law requires, because we think your community deserves that.
3A.2 Definitions: What Counts as What
We recognise that ‘AI’ covers a wide and fast-moving range of tools and workflows. The following classification is our current working framework. We will update it as the technology and the conversation evolve.
Category | Description | Required label |
|---|---|---|
No label required | Entirely created by a human artist, including all source materials |
|
AI-assisted | Human-led work where AI tools were used for specific steps — e.g. background generation, colour grading, texture reference | ✨AI-assisted |
AI-generated | Primary visual output produced by a generative AI model from a text or image prompt | 🤖AI-generated |
AI-collaborative | A deliberate creative dialogue between artist and AI, where human and machine contributions are intentionally intertwined and equally weighted | 🤖✨AI-collaborative |
If your process doesn’t fit cleanly into one of these categories, default to the label that most accurately describes the role AI played. When in doubt, disclose more rather than less. Your audience will respect honesty far more than they’ll resent a label.
3A.3 Disclosure Requirements
When disclosure is required
You must apply an AI label (as defined in Section 3A.2) whenever a visual work delivered through Konduktum meets any of the following:
- The primary visual output was generated by an AI model, in whole or in significant part
- An AI tool produced image elements — backgrounds, characters, textures, compositing layers — that appear in the final work
- You used a generative AI model to produce reference imagery that directly shaped the final output
When disclosure is not required
You are not required to label your work when AI tools were used only for:
- Post-processing or colour correction (e.g. AI-powered noise reduction, upscaling)
- Administrative tasks unrelated to the visual output (e.g. generating a project brief, captioning)
- Tools where the AI component is invisible infrastructure and the creative output is entirely yours
If you’re not sure whether your use of AI crosses into ‘AI-assisted’ territory, ask yourself: ‘Would a reasonable fan feel surprised or misled if they knew I used this tool?’ If yes, disclose.
How to label your work on Konduktum
When publishing a demand or delivering content, you will see an AI disclosure field in the upload interface. Select the applicable label from the dropdown. This label will appear visibly and permanently alongside your work on the platform.
Labels cannot be removed after delivery. If you mislabelled a work, contact support@konduktum.com and we will correct it in the record with a logged amendment.
3A.4 What Konduktum Will Not Do With Disclosure Data
Disclosure is for your audience. It is not an audit tool, a basis for ranking or algorithmic penalty, or a data point we sell, share, or use commercially.
Specifically, Konduktum commits that:
- AI labels will not affect your visibility, ranking, or discoverability on the platform
- Disclosure data will not be shared with third parties for any purpose
- We will not use AI label data to draw conclusions about or make decisions regarding your account
- AI-labelled work receives the same platform protections, creator ownership rights, and fee structure as all other content
Labelling your work as AI-assisted or AI-generated does not reduce your rights under Section 3. You still own your content. You still control your audience relationship. Nothing changes except that your audience knows how the work was made.
Filtering AI Content — Your Choice, Your Settings
We will build and maintain a platform-level filter that allows any user — creator or fan — to choose whether AI-labelled content appears in their experience.
This is opt-in, not opt-out. The default is that all content is visible. If you want to filter AI-assisted or AI-generated work from your inbox and discovery feed, you turn it on. If you don't, nothing changes.
The filter is yours to set, change, or remove at any time. Konduktum will never make that decision on your behalf — not algorithmically, not by default, and not in response to platform trends or commercial pressure.
What the filter does:
- Hides content labelled AI-generated or AI-assisted from your inbox and feed, based on the labels creators apply under Section 3A.2
- Applies to new content only — it does not retroactively remove content you have already received
- Has no effect on the creator's reach to subscribers who have not enabled the filter
What the filter does not do:
- It does not penalise creators whose work is filtered — reach, visibility, and fee structure are unaffected
- It does not share your filter preference with creators, advertisers, or third parties
- It does not affect your ability to visit a creator's profile and view their work directly
3A.5 Grey Areas and Community Disputes
We are not the arbiters of what counts as ‘real’ creative work. We are not going to adjudicate philosophical disputes about authorship or authenticity in the context of AI.
However, if a fan believes a creator has delivered AI-generated content without appropriate disclosure, they may raise a dispute through our standard support process. We will review the dispute and, where the evidence is clear, require the creator to correct the label or issue a refund to affected pledgers.
Repeated or deliberate mislabelling, particularly where it is used to deceive fans into funding work under false pretences, may result in account suspension.
Important: Mislabelling is not about artistic legitimacy. It is about honesty with the people who funded you. We take the former lightly and the latter seriously.
3A.6 Your Content and AI Training Data
Konduktum does not use your content to train AI models. We do not license your content to AI training datasets. We do not allow third parties to scrape or collect your content for training purposes.
This applies to all content on the platform regardless of whether it is AI-labelled or not.
If you discover that your work has been used in an AI training dataset without your consent, please report it to support@konduktum.com. We will take all available technical and legal steps to support your claim.
This commitment is not just contractual — it reflects what we believe. Artists should not be made into fuel for AI systems they did not consent to train.
3A.7 How This Section Will Evolve
The technology, the regulation, and the community conversation around AI in creative work are all moving fast. We commit to reviewing this section at least annually and updating it in consultation with our creator community.
When we update this section, we will:
- Notify all creators by email at least 30 days before changes take effect
- Publish a plain-English changelog explaining what changed and why
- Give you the right to close your account and export your data if you do not agree
If you have views on how this section should evolve — from experience, from the creative community, or from your own practice — we want to hear them. support@konduktum.com.
4. Your Audience Is Yours: Data Ownership & Portability
4.1 Your Subscriber List
The audience you build on Konduktum is yours. The subscriber list you accumulate — names and email addresses of fans who have opted in to receive your work — belongs to you, not to us.
4.2 Full Portability, No Restrictions
If you decide to leave Konduktum — for any reason, at any time — you can export your complete subscriber list with no restrictions, no fees, and no conditions attached. We will provide your data in a standard, portable format (CSV) within 5 business days of your request.
We will never hold your audience hostage. Locking creators into a platform by trapping their audience data is an extractive practice we explicitly reject.
4.3 What Happens to Your Data When You Leave
Upon account closure, you receive your full data export. Konduktum will delete your personal data from our active systems within 30 days, retaining only what is legally required for tax and financial compliance under Estonian and EU law (specifically, transaction records as required under Directive 2011/85/EU and applicable VAT regulations).
Your content files will be deleted from our servers within 30 days of account closure unless you request an extension.
4.4 Data We Collect and Why
We collect only what is necessary to operate the platform: account information, payment processing data (handled by our payment processor, never stored by us in raw form), subscriber email addresses on your behalf, and basic platform usage analytics.
We do not sell your data. We do not share your data with advertisers. We do not build behavioural profiles for commercial purposes.
Full details are in our Privacy Policy at konduktum.com/privacy.
5. Intellectual Property in Demands
5.1 Creator Owns the Delivered Work
When a creator accepts a Demand and delivers the resulting work, the intellectual property in that work belongs entirely to the creator. The Pledger who initiated the Demand acquires no copyright, no licence, no ownership claim, and no legal rights over the delivered work beyond the right to receive and personally enjoy it as agreed.
The idea expressed in a Demand — once accepted — becomes the creative property of the creator who realises it. The creator’s interpretation, execution, and expression are theirs alone.
5.2 Fan Attribution Norm
While Pledgers hold no legal rights over delivered work, Konduktum encourages a culture of acknowledgement. When a creator accepts a Demand, we invite (but do not require) creators to acknowledge the Pledger’s role in inspiring the project — in liner notes, video descriptions, or wherever feels natural.
This is a cultural norm, not a contractual obligation. Attribution is a gift from the creator, not a right of the Pledger. Creators remain the sole author and owner of the work in every legal and moral sense.
5.3 Pledger Representations
By submitting a Demand, Pledgers confirm that the requested content does not infringe any third party’s intellectual property rights, does not constitute harassment or targeted harm toward the creator, and complies with Konduktum’s community standards.
6. Fees: Transparent and Simple
Konduktum offers four plans. Fees are applied only on funded Demands — you are never charged unless a creator accepts and a transaction completes.
6.1 Platform Plans and Fees
Konnekt — Free (€0/day)
Audience-only plan. No platform fee. Konnekt users can read, explore, and participate in Demands. No creator publishing features are included.
Kollaborate — Free (€0/day)
Entry creator plan. Includes all kontent types, 5 GB storage, and newsletter delivery to a small audience (up to 500 emails). Konduktum platform fee: 15% per funded Demand (you keep 85% before Stripe processing fees). No daily subscription charge. A soft subscriber threshold applies — your existing audience retains full access to published content at all times. When you are ready to grow past the threshold, upgrading unlocks the next post.
Kondukt — Pro (€0.64/day)
Full creator plan. Includes 50+ GB storage, 3,000+ emails per month, and full community-building features. Konduktum platform fee: 9% per funded Demand (you keep 91% before Stripe processing fees). The daily subscription of €0.64 is covered the moment your fans fund anything over €11.
Konfigure — Pro (€7/day)
Enterprise and tailored plan. Pricing, features, and platform fee are agreed directly with Konduktum on a case-by-case basis. Contact support@konduktum.com to discuss.
6.2 Stripe Payment Processing Fees
Konduktum uses Stripe to process all payments. Stripe charges its own processing fees on every transaction, which are deducted from the payment before it reaches Konduktum. These fees are set by Stripe, not by us, and are outside our control. They are listed here in full so you know exactly what to expect.
Standard card processing (per transaction)
- Standard EEA cards (most European fans):1.5% + €0.25
- Premium EEA cards (some rewards/corporate cards):1.9% + €0.25
- UK cards:2.5% + €0.25
- International cards (non-EEA, non-UK):3.25% + €0.25
- Currency conversion (when fan pays in a different currency):+ 2% additional
- SEPA Direct Debit:€0.35 flat
Disputes and chargebacks
If a fan disputes a charge with their bank, Stripe charges €20 per dispute received. If the dispute is resolved in the creator’s favour, this fee is returned. If the dispute is lost, the fee is not returned. Konduktum will notify affected creators promptly and provide all available evidence to support their case. Creators should retain records of accepted Demands and delivered content, as these are the primary evidence in dispute resolution.
Refunds
When a refund is issued, Stripe does not return the original processing fee. This means the net cost of a refund includes the initial Stripe transaction fee on the original payment. There are no additional Konduktum charges for issuing a refund.
6.3 What You Actually Receive: A Plain-English Example
On a €100 funded Demand from a standard EEA fan paying in euros:
- Stripe fee: €1.75 (1.5% + €0.25)
- Konduktum fee on Kollaborate: €15.00 (15%)
- You receive: €83.25 on Kollaborate
- Konduktum fee on Kondukt: €9.00 (9%)
- You receive: €89.25 on Kondukt
Actual amounts will vary based on the fan’s card type, country, and currency. Stripe fees are charged and deducted by Stripe directly and are visible in your Stripe dashboard per transaction.
6.4 Changes to Stripe Fees
Stripe’s fees are set and may be changed by Stripe independently of Konduktum. When Stripe updates its pricing, we will update this section within 30 days and notify creators by email. The current authoritative source is always stripe.com/en-ee/pricing.
This platform is two people and no investors. Every fee goes directly into keeping Konduktum independent, fast, and free of the incentives that broke every other platform you’ve tried. We make money when you make money — and not before.
7. Community Standards
We do not tolerate demands for content that involves discrimination, violence, sexual content involving minors, or anything that violates applicable law. Konduktum is a small, passionate team, and we take community safety seriously.
Creators may always reject content that makes them uncomfortable, regardless of the demand amount or community pressure. Your creative and personal boundaries are non-negotiable.
Reported violations will be reviewed and removed promptly. Repeat or egregious violations will result in account termination.
8. Account Terms
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate registration information and update it when it changes.
Konduktum reserves the right to suspend or terminate accounts that violate these Terms, impersonate others, or engage in fraudulent activity. We will always attempt to notify you before taking action, except where immediate action is required to protect the community.
9. Prohibited Activities
You may not use Konduktum to:
- Infringe any intellectual property rights
- Harass, threaten, or abuse other users or creators
- Submit false, misleading, or fraudulent Demands
- Circumvent our technical systems or attempt to access others’ accounts
- Use automated tools to scrape or extract data from the platform
- Engage in any activity that violates applicable law
10. Feedback and Suggestions
If you share feedback, feature ideas, or suggestions with us, we may use them to improve the platform. We appreciate this and take it seriously.
We will not claim ownership of your feedback ideas in a way that prevents you from using them yourself, sharing them publicly, or pursuing them independently. The narrow legal right we retain is to incorporate feedback into Konduktum’s platform development — nothing broader than that.
11. Liability and Disclaimers
Konduktum provides the platform infrastructure. We are not responsible for the content created or delivered by creators, the demands submitted by pledgers, or disputes between creators and pledgers over delivered work.
To the maximum extent permitted by law, Konduktum’s liability in any matter is limited to the fees paid to us by you in the 12 months preceding the claim.
The platform is provided “as is.” We do our best to maintain uptime and reliability, but cannot guarantee uninterrupted service.
12. Governing Law and Disputes
These Terms are governed by the laws of Estonia. If you are an EU consumer, you additionally benefit from the mandatory protections of the law in your country of residence.
Disputes may be raised with the courts of Tallinn, or, for EU consumers, in the EU country where you reside. The European Commission’s online dispute resolution platform is available at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Notify you by email at least 30 days before changes take effect
- Clearly explain what is changing and why
- Give you the right to close your account and export your data if you do not agree with the changes
We will not make changes retroactively. Terms in place when you joined govern transactions from that period.
